Retail leases are complex, lengthy and very detailed and require a comprehensive and thorough review so that all terms and conditions of the proposed lease are in line with the client’s offer to lease or letter of intent (LOI). We will also ensure that no new negative terms or conditions have been introduced in the proposed new lease.
Deborah and Bill have worked together for over 35 years for some of the largest shopping center developers in the country and have done literally thousands of retail leases in all types of settings, be it a shopping center, enclosed mall, strip center, stand-alone building or lifestyle center. We are very experienced in legal, lease and construction issues relating to franchisees. We will guide the client through the entire process from where the client is now until the date the client opens for business. We will ensure that the terms and conditions of the client’s new lease are explained in a clear and non-intimidating way, and are in line with the client’s understanding and expectations. We will also make sure that the client is made fully aware of all essential terms and provisions, as well as any risks contained in the proposed new lease. This allows the client to make the best decisions for its business.
New Leases
Depending on what stage of the lease negotiation process the client is at, we will begin with a thorough analysis of the offer to lease or letter of intent (LOI), or if the case may be, the proposed new lease as well, and will discuss all terms and conditions with the client prior to offering our recommendations and realistic expectations. If we are negotiating a new lease on behalf of a retail tenant, then at tenant’s option, we will approach the landlord or landlord’s representative to negotiate the terms and conditions of the tenant’s proposed new lease, keeping the tenant advised every step of the way as we progress through the lease negotiation process. Upon full execution of the client’s new lease, we will provide the client with a fully executed copy and a professional report containing an itemized list of our professional activity on the client’s behalf.
Renewals
Renewing or extending a retail lease can be a very stressful time for retail tenants especially during these trying times. The tenant may want to stay in its same space but needs the terms of its renewal lease to be in line with its business. We will begin with a thorough and comprehensive review of the tenant’s existing lease, any pre-negotiated business terms, and any renewal lease or extension agreement that may have already been drafted. We will offer our analysis, recommendations and realistic expectations upon completion of our review. We will then proceed to negotiate the terms and conditions of the tenant’s renewal lease or extension agreement, as the case may be, keeping the tenant advised every step of the way as we progress through the lease negotiation process. Upon full execution of the tenant’s renewal lease or extension agreement, we will provide the tenant with a fully executed copy as well as a professional report containing an itemized list of our professional activity on the tenant’s behalf.
